1. Common Law: Odco Pty Ltd v BWIU & Ors
The first case before Justice Woodward in the Federal Court declared the common law contractor status of Odco contractors.
The published judgments of the trial judge Woodward, J. in the action Odco Pty Ltd v BWIU & Ors. No. VG 151 of 1988 in the Federal Court of Australia (unreported) and dated 24 August 1989.
The Full Court of the Federal Court then considered an appeal on the Woodward judgment. The decision of the Full Court confirmed the common law contractor status as declared by Woodward J.
The appeal judgment in BWIU & Ors. v Odco Pty Ltd No. VG 322 of 1989 in the Federal Court of Australia reported at (1991) 29 FCR 104.
The High Court refused leave to appeal in late 1991. The common law Federal Court decision of Justice Woodward stood.
