3. Unfair Dismissal: Fox v Kangan-Batman TAFE
This important test case involved a 1999 unfair dismissal application against the end user client by a teacher working through an Odco agency.
It was appealed to the Full Bench of the Australian Industrial Relations Commission where it was ruled that there was no contract of any sort between the Odco contractor and the end user client business.
