4. Unfair Dismissal: Sheehan v Australian Contracting Solutions
In this case, heard in the IRC of NSW, a contractor lodged an unfair dismissal claim against an Odco agency, claiming he had always believed he was an employee of the agency.
The evidence demonstrated that this was not the case, and the application was dismissed on the grounds that the applicant was not an employee, and no jurisdiction existed.
